I was not there of course. However:
* Parked/stopped car - highly unlikely the scooterist was using the bike lane to prepare to turn left, nor to park. It's only 50m use anyway.
* Passing an 'obstruction'
obstruction includes a traffic hazard, but does not include a vehicle only because the vehicle is stopped in traffic or is travelling more slowly than other vehicles;
Lots of drivers don't understand this bit. You cannot legally just jump into the bike lane because a vehicle is stopped in traffic. It is OK to pass a vehicle stopped to do a right turn, but there was no mention of this by the OP.
